Welcome to Invense. These Terms of Service ("Terms") govern your access to and use of the Invense website (invense.co.in) and related services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Description of Service

Invense is a financial news intelligence platform that aggregates, analyzes, and summarizes financial news using artificial intelligence, including models from OpenAI, Anthropic, and Google. The Service provides AI-powered news analysis, sentiment scoring, stock impact assessment, and news feeds. AI-generated content is labelled as such within the Service in accordance with applicable transparency requirements, including Article 50 of the EU AI Act (Regulation (EU) 2024/1689).

2. Eligibility & Account Registration

You must be at least 18 years old to use the Service. By creating an account, you represent that:

• You are at least 18 years of age
• The information you provide is accurate and complete
• You will maintain the security of your account credentials
• You will notify us immediately of any unauthorized access

You are responsible for all activity that occurs under your account.

3. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Scrape, crawl, or automatically extract data from the Service
• Redistribute, republish, or commercially exploit the content without permission
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or its infrastructure
• Use the Service to generate spam or misleading content
• Impersonate another person or entity

4. AI-Generated Content

The Service uses artificial intelligence to analyze, summarize, and score news articles. You acknowledge that:

• AI-generated summaries and analysis may contain errors or inaccuracies
• Bias scores and sentiment analysis are algorithmic assessments, not definitive judgments
• AI outputs may reflect biases present in the underlying AI models or source data
• AI-generated analyses are not individually reviewed by humans before publication
• AI-generated content should not be the sole basis for any financial decision
• We use third-party AI providers (OpenAI, Anthropic, Google) to process news content - your personal data is not shared with these providers
• We continuously improve our AI models but do not guarantee perfection

5. Content Reporting & Moderation

Invense provides an in-app reporting feature that allows you to flag AI-generated content you believe is inaccurate, offensive, harmful, or otherwise inappropriate. When you submit a report:

• Your report (including reason, optional details, and the content reported) is stored and reviewed by our team
• We may acknowledge your report, take action (including redacting or suppressing the flagged analysis), or dismiss the report if no action is warranted
• Reports are reviewed by humans, not solely by automated systems
• There is no retaliation for good-faith reports

We reserve the right to redact, suppress, or remove any AI-generated content that does not meet our quality or safety standards.

6. Not Financial Advice

Regulatory status: Invense is not registered as an Investment Adviser with the US Securities and Exchange Commission (SEC). Invense is not registered as a Research Analyst or Investment Adviser with the Securities and Exchange Board of India (SEBI).

The stock impact assessments displayed in the Service (for example, identifying stocks that may be affected by a news event, with a directional indicator) are AI-generated contextual analysis of publicly available news articles. They do not constitute research reports, buy/sell/hold recommendations, or personalized investment advice. They are news analysis, not securities advice.

Any investment decisions you make are your sole responsibility. Past performance of any security or market does not guarantee future results. You should independently verify all information before making any financial decisions.

For users in India: Investment in the securities market is subject to market risks. Users in India should consult a SEBI-registered Research Analyst before making any investment decisions. Do not make investment decisions based solely on content from this Service.

7. Intellectual Property

The Service, including its design, features, AI models, and proprietary analysis, is owned by Invense. News articles and source content are the property of their respective publishers. Your use of the Service does not grant you ownership of any intellectual property.

8. Data & Privacy

Your privacy matters to us. Please review our Privacy Policy for details on how we collect, use, and protect your information.

9. Account Termination

You may request account deletion at any time through your profile page. Deletion requests are reviewed by our team within 48 hours; you will receive a confirmation email once your account has been processed. We reserve the right to suspend or terminate accounts that violate these Terms. Upon termination, your data will be handled in accordance with our Privacy Policy.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Invense is a free service. No payment is required to access the Service. The absence of a fee does not create an obligation to maintain, update, or continue providing the Service. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated content will be accurate or complete.

11. Limitation of Liability

To the maximum extent permitted by law, Invense shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. This includes, without limitation, any losses resulting from:

• Reliance on any information provided through the Service
• Investment or financial decisions made based on content in the Service
• Interruption or unavailability of the Service
• Errors or inaccuracies in AI-generated content

12. Indemnification

You agree to indemnify and hold harmless Invense, its officers, directors, employees, and agents from any claims, liabilities, damages, or expenses arising from your use of the Service or violation of these Terms.

13. Third-Party Services

The Service may integrate with or link to third-party services (news sources, data providers, authentication services). We are not responsible for the content, privacy practices, or availability of third-party services.

14. Force Majeure

Invense shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond its reasonable control, including but not limited to natural disasters, internet outages, third-party service disruptions, government actions, or cyberattacks.

15. Modifications

We may update these Terms from time to time. If we make material changes, we will notify you through the Service or by email. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

16. Governing Law

These Terms are governed by the laws of India. Any disputes arising from these Terms or the Service shall be resolved through arbitration in accordance with the Arbitration and Conciliation Act, 1996.

If you are located in the European Union or European Economic Area, you additionally benefit from any mandatory consumer protection provisions of your country of residence that cannot be excluded by contract. For EU/EEA residents, your GDPR data rights apply as described in our Privacy Policy, regardless of the governing law of these Terms.

18. EU Users

This section applies to users located in the European Union or European Economic Area.

• GDPR Rights - Your rights under the General Data Protection Regulation (GDPR) apply in full, including rights of access, rectification, erasure, restriction, objection, and data portability. See our Privacy Policy for details on how to exercise these rights.
• EU AI Act Compliance - Invense is classified as a limited-risk AI system under the EU AI Act (Regulation (EU) 2024/1689). All AI-generated content within the Service is clearly labelled. Invense does not make high-risk AI decisions (as defined in Annex III of the EU AI Act) about individual users. Users may question or report any AI-generated content using the in-app reporting feature.
• Contact for Data Requests - To exercise your EU data rights or for any data protection enquiry, contact us at support@invense.co.in. If you are unsatisfied with our response, you have the right to lodge a complaint with your national data protection supervisory authority.

19. Indian Users

This section applies to users located in India.

• DPDPA Rights - Under the Digital Personal Data Protection Act, 2023, you have rights as a Data Principal, including the right to access, correct, and erase your personal data, and the right to withdraw consent. See our Privacy Policy for details on how to exercise these rights.
• Grievance Redressal - If you are unsatisfied with our handling of your data, you may file a complaint with the Data Protection Board of India.
• Investment Disclaimer - Investment in the securities market is subject to market risks. Users in India should consult a SEBI-registered Research Analyst before making investment decisions. Do not make investment decisions based solely on content from this Service.

20. Regulatory Status

This section discloses Invense's regulatory status under securities laws in the jurisdictions where we operate.

United States (SEC)

Invense is not registered as an Investment Adviser with the US Securities and Exchange Commission (SEC) under the Investment Advisers Act of 1940. Invense operates as a financial news publisher under the publisher's exclusion (Section 202(a)(11)(D) of the IAA). The Service provides general, impersonal financial news analysis available to all users equally. It does not provide personalized investment advice, execute trades, or manage user funds.

Nothing in the Service constitutes a recommendation or solicitation to buy or sell any security. Past performance of any security is not indicative of future results.

India (SEBI)

Invense is not registered as a Research Analyst or Investment Adviser with the Securities and Exchange Board of India (SEBI). The stock impact assessments displayed in the Service are AI-generated contextual analysis of publicly available news events and do not constitute research reports as defined under the SEBI (Research Analysts) Regulations, 2014.

Investment in securities market is subject to market risks. Read all related documents carefully before investing. Registration granted by SEBI and certification from NISM in no way guarantee performance or assurance of returns to investors. Users in India are strongly encouraged to consult a SEBI-registered Research Analyst (bearing a valid SEBI registration number in the format INH-XXXXXXXX) before making any investment decisions.

Other Jurisdictions

Invense does not hold any broker-dealer, investment adviser, or securities registration in any jurisdiction. The Service is an informational news platform only. If you are accessing the Service from a jurisdiction with specific requirements for financial information providers, please ensure compliance with your local regulations before relying on any content in the Service.

21. Severability

If any provision of these Terms is held to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

22. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Invense regarding the Service, and supersede any prior agreements or understandings.
